sociedad conyugal If a person who is married under "sociedad conyugal" wishes to sell some real estate he/she has to obtain the written consent of his/her wife/husband.
prenuptial agreements Prenuptial agreements have nothing to do with this. In Mexico there are two modalities by which you may get married, "sociedad conyugal", which means that husband and wife own all their assets jointly and "separación de bienes" in which husband and wife keep their estates separate. This is independent from any prenuptial agreement. I should know; I am married under the "régimen de sociedad conyugal".

I am not sure about the exact wording, but in Mexico a marriage is made under one of two modalities: sociedad conyugal, in which both husband and wife share all their assets, and separación de bienes, in which each one owns his/her own separately.

As I understand it.

"Capitulacion" means pact or agreement, and here it may refer to an additional stipulation.


A stipulation of settlement is an addendum to a contract to protect any personal, public, or private interests in the event of a particular outcome.

(i.e. The court case was in my favor, but in order to collect my settlement, I have to sign a gag order that prevents me from talking about the conditions of my settlement to anyone.)
