I agree... I think that Arts. 407 and 408 are mentioned as part of a previous item in the list of items. Katherine, could you post the full sentence here to clarify this doubt?

More context is needed. Arts 407 and 408 seem to have nothing to do with the question.

Acho que houve uma separação infeliz do termo a traduzir. Parece que se trata de uma lista de itens, e os últimos dois itens são:
"a igualdade de tratamento entre as partes" e
"julgados do Superior Tribunal de Justiça"
que seriam traduzidos como
"equal treatment of the parties"
"decisions of the Supreme Court of Justice"

Pois o termo "partes" inclui o autor e o réu, e portanto a palavra "julgados" não pode se referir ao réu (e também não significa réu!).

"julgado" significa "3 Sentença pronunciada pelo juiz". (veja link abaixo).

Acredito que o contexto anterior ao reproduzido acima deixaria isso claro.

Yes. The articles mentioned refer to witnesses. Nothing to do with the rest of the context.
