Να μην παραχωρεί ή επιβαρύνει εμπραγμάτως το πλοίο αν δεν ενημερώσει και δεν εγκρίνει εγγράφως ο υπέρ ου η υποθήκη.
Some form of wording with "real encumbrance", perhaps? Please let me know if there is a well-established set phrase for this.

It looks as if it's intended in the sense: "without notifying, and receiving the written approval of, the mortgagee".

υπερ ου : in modern Greek would be υπερ του οποίου (to the benefit of), thus it is the mortgagee...
