frachtfreie Lieferung

German to English Law/Patents Transport / Transportation / Shipping Terms and Conditions
"Ist frachtfreie Lieferung vereinbart, ohne dass die Sendung freigemacht oder die Fracht von der Rechnung abgezogen ist, so hat der Kaeufer die Fracht zu verauslagen, er darf sie vom Rechnungsbetrag kuerzen."

"If freight-free delivery is agreed but without delivery being free of charge or deducted from the invoice, the buyer must disburse the freight charges and may then deduct them from the invoice amount."

Do you feel my English translation corresponds with the German? I find it odd that something can be described as freight-free, but then the client is still liable to pay shipping costs even though it appears s/he can deduct them from the final invoice amount.

If freight paid is agreed, but delivery is not prepaid or freight costs are not deducted from the invoice, the buyer shall advance the freight charges and may then deduct this amount from the invoice total.

Die Sendung freimachen is to prepay postage. So my understanding is:

If freight-free delivery is agreed *but postage has not been prepaid* or deducted from the invoice, the buyer must disburse the freight charges and may then deduct them from the invoice amount.

I got into a pickle when the text talked about postage free but then the customer would have to pay for it anyway and get a refund later. The law(d) works in mysterious ways."

Your mistake is translating "freimachen" as "free of charge" - it actually means that the postage is paid.

"ohne daß die Sendung freigemacht...ist" = "without freight charges/postage on the shipment being paid"

In case the shipper hadn't been prepaid the shipping even though free shipping had been agreed, the recipient must pay the company that delivers the freight and may then deduct the expense from the final invoice.

This clause seems to cover the cases when against all best intentions the shipping through a third party company has not been prepaid and the shipping costs are then due at the time of delivery.

It seems that this may have caused the trouble.

The client advances shipping fees for return by the seller. Instead of waiting for the returned amount, s/he is free to deduct the fees from the invoice amount.
