Bei Köbler (Köbler, Gerhard: Rechtsenglisch: deutsch-englisches und englisch-deutsches Rechtswörterbuch für jedermann.) habe ich noch \"disturber by state\" gefunden, aber ich glaube, dass der oben erwähnte Ausdruck eher zutreffend ist. Zustandsstörer im Glossar des Umweltbundesamtes bezieht sich auf den Zustandsstörer bei Altlasten.

Yes, I actually had the same misgivings initially. Romain does give my translation, but they may be referring exclusively to a more political or public law context (although their supplementary explanation \"person legally responsible for conduct necessitating intervention by the state\" does arguably fit your context too). You may be looking for the term desribing someone who commits a public or common nuisance, a tortfeasor perhaps: a more specific term escapes me at the moment (not sure one exists, though).

: Zustandstörer is someone who can become liable through ownership of a dangerous article alone, as opposed to a Handlungs-/Verhaltensstörer, who has to do something wrong. Maybe you could also say "the person is subject to owner's liability"
