I'm not sure, but I'd say it's the mother who is being "invited" - i.e. the person who instituted the action.

I've expanded the question to make sthg out of it.

In the UK, each side attends a CMC - case management conference and agrees on a witness, instead of past practice of trooping an endless and time-wasting number of expert witnesses who contradict each other.

In DE, there may be no such conf., but the case conduct idea is still very similar.
Example sentence:

From what I gather, "prozessleitend" / "verfahrensleitend" are steps taken in advance of a trial / proceedings / hearing to set the boundaries / parameters, as is explained in http://www.proz.com/kudoz/140752

In the US, this would mean trial preparation. See
