French term
statuant sur requête
French to English
Law/Patents
Law: Contract(s)
I know this has been asked before but opinion seemed to be divided. Does this refer to ex parte proceedings or simply "on application"? thanks

Andrew Bruch
: or "in an exparte proceeding" == Black's describes exparte application (or motion) as being a motion made to the court without notice to the adverse party; the judge then rules in an ex parte proceeding

AllegroTrans
: "ex parte" is a specific application made by a party for emergency relief (usually without the attendance or prior knowledge of the opposing party): nothing in the FR text indicates this is the case here

CFK TRAD

: is it possible that this application might be termed a "petition"? Could "pursuant to" be shortened to "upon"?
