In a sale of goods context failure to open a letter of credit by the date provided for or failure to ship by the date provided for is invariably regarded as a repudiatory breach.

A repudiatory breach is a breach of a contract which is so serious that it goes to the core of the contract and deprives the innocent party of its benefit.

(takdire bağlı) fesih hakkı veren ihlal

A breach of contract that gives the aggrieved party the right to choose either to end the contract or to affirm it. In either case, the aggrieved party may also claim damages.
A breach of condition is normally repudiatory, as is breach of an intermediate term that deprives the other party of substantially the whole benefit of the contract. A contract may also be repudiated before the time for performance has arrived.
