A Litigation Friend will be somebody close to or related to the child, eg, mother, father, but must:-
Act fairly and competently conduct the proceedings on behalf of the child.
Have no interest adverse to that child.
Undertake to pay any costs which the child may be ordered to pay in relation to those proceedings.
Must not have any potential liability in the incident from which the claim derives (eg, mother driving child and collides with the rear of the preceding vehicle. The child suffers injury but the mother cannot act as Litigation Friend).

A child under 18 or a patient (defined as an adult who is incapable of managing or administering his/her own affairs) can only bring a claim or take Court proceedings through what is called a litigation friend. The litigation friend (LF) must be someone who can fairly and competently deal with matters on behalf of the child or patient and they must have no interest adverse to that of the child or patient. If Court proceedings are commenced, they undertake to pay any costs
