16. To address the practical issues arising from the situation described in section 4.1 above, Member States agree that: (i) the profits of the related enterprises with respect to the commercial or financial relations between them need to be calculated symmetrically, i.e. enterprises participating in a transaction should use the same price for the respective transactions, and that (ii) a compensating adjustment initiated by the taxpayer should be accepted if the conditions listed below are fulfilled

Il prezzo di trasferimento, infatti, nel caso di operazioni commerciali tra imprese di uno stesso gruppo multinazionale, è il prezzo che risponde al cosiddetto arm’s length principle'' ...
'' In materia di prezzi di trasferimento, però, i dizionari non servono più: l'arm’s length principle si traduce in italiano con «principio di libera concorrenza».
