\"to reserve all rights to further action\", which is the intended meaning here, has a very different meaning from \"making an impartial judgement/ruling\"

我理解，terminated "without prejudice" 在这里的意思是这些人被解聘不是因为渎职或犯罪，而是因为不适任或有小过失。 因此，这次解聘不会影响他们以后再任其他职务。

企业由于生意清淡和职位调整等原因解雇员工，如果员工没有过失，也叫做terminated without prejudice。

我这样理解的理由之一是考虑这里的几个数字。11年中任命了17,971 人。如果解职(terminated)的11,982 人是有违法犯罪嫌疑，加上已定罪名而开除(dismissed )的 1,604 人，共 13,586 人，占总任命人数的 75.6 %。比例太高不合情理。这样烂透了的机构不太可能存在 11 年。

在西方国家，一个人被雇佣单位解聘，可能的不利影响主要有两条：一是影响他再次受聘；而是影响他领取失业保险金的资格。

一个人如果因违法纪律而被开除，他是没有资格领取失业保险金的。再次找工作时，如果招聘单位资询他的前雇主，对他也有不利影响。如果他被解聘不是由于个人过失，而是由于雇主方面的原因，这两方面都没有不良影响。

without prejudice似乎可以粗糙地理解为without showing cause 或without a showing of a "fireable" offense。

这里面没有原告、被告，因为这是bureau内部的HR行为。

这1604人，bureau要证明misconduct，所以可能有一套较为繁琐的程序，比如要举行听证会，要提供证据，要让本人申辩，等等。

这11982中可能有人是因为其职位冗余被解职，但可能有更多一部分人犯了错误，只是bureau因为缺乏证据、证据的讨论可能会embarras or bring discredit to the bureau、错误太小、走听证会途径太麻烦等的原因，而选择简便的without prejudice 途径。

其结果是，without prejudice 途径，对被解职者的惠益是，这不是fire的记录，而可以看作constructive resignation，可以保留退休金、失业金等福利；对bureau的惠益是，雇员不可以sue the bureau for wrongful termination。所以这是一个和解。事实上，通过without prejudice 途径，双方已经解决了在劳动法上对解雇这个行为的可能争议。日后如果要追究贿赂等情节，那是公诉机关的事情。

In this context, it means that the 11,982 were terminated NOT FOR CAUSE and were therefore eligible for benefits/rehire. Contrast with the rest who were released FOR cause, such as theft.

这跟Xiaoping/Xianjun的说法相近。
