The Italian refers to some previously proposed action and just states, in a very formal way, that in case that action is accepted the 1st article of the statute should be modified as explained later in the document.

Proposto - you could also say "put forward".
i.e. "should this have already been put forward at an earlier date/time...."

No it doesn't actually.//Your comment does not make sense to me. "Should have" is similar to a subjunctive-type clause.
