The meaning is clear, however, which would be the best way to put it in English? Any suggestions?

Die Parteien verpflichten sich, entweder das Übergabeprotokoll oder einen Nachtrag zum Untermietvertrag in der Schriftform des § 550 BGB zu erstellen, in dem der Tag der Übergabe und des Untermietbeginns formgerecht festgehalten wird.
Die Parteien sind sich einig, dass sie sich nicht auf einen etwaigen Schriftformmangel aufgrund des ungewissen Mietbeginns berufen werden.

The Parties agree that they will not refer to a lack of a written form requirement due to the uncertain rental period???

I would have put it like this Vlad
"The Parties agree/undertake not to invoke the absence of a written (whatever you have put for "Übergabeprotokoll oder Nachtrag zum Untermietvertrag") because of the uncertain lease start date."

§ 550 of the BGB says this (if it is of help)
Form des Mietvertrags

Wird der Mietvertrag für längere Zeit als ein Jahr nicht in schriftlicher Form geschlossen, so gilt er für unbestimmte Zeit. Die Kündigung ist jedoch frühestens zum Ablauf eines Jahres nach Überlassung des Wohnraums zulässig.

Failure to comply with the requirement for written form

is how I would translate this

N.B. "Mietbeginn" is the date of commencement of the lease (strictly the date payment of rent commences) NOT the length of the lease

Thanks Adrian - except "requirement of" is not a grammatical structure I have ever come across.
