извещение...о ведущемся против него судебном процессе

В данном случае извещение должника о ведущемся против него судебном процессе в иностранном суде было сделано по правилам английского судопроизводства и являлось эффективным, так как фактически было получено находящимся в Российской Федерации должником, что установлено судами.
Однако это извещение не соответствовало применимому международному договору Российской Федерации - Гаагской конвенции от 15.11.1965, действующей для Российской Федерации с учетом сделанных ею в установленном порядке заявлений, и в этом смысле не являлось надлежащим.
