IMHO - here it would, therefore, not apply at all as we are in stages where further facts are no longer being admitted to courts.
Secondly, the court would not, IMO, be giving "allegations", even if it applied in this case, it is the other party, and I think, again, it would apply to actual charges, which is not the case here.
