This is from an appeal against an arbitration agreement. The context is Swiss. Although I've given "mal licite" as my troublesome term, the whole sentence has me baffled. Any help would be much appreciated.

If I understand it correctly, the "mal licite" is something that is
technically illegal, but not in an obvious way an immoral
or hurtful act. This would be "malum prohibitum", in contradistinction to
a "malum in se", acts that are obviously hurtful, and you don't
have to check local statutes to know that this is a bad act.
