English to French Bus/Financial Finance (general)

Damages shall be increased by th eincreased Tax cost incurred by the indemnified party in respect of any indemnity payment received, and shall be net of the Tax benefit to the indemnified party of any loss, deduction or credit arising from the incurrence or payment of the Damages (such amount a "Benefit Item"), so that the Indemnified party shall be in the same position as it would have been had the Damaged not occured.
