German to English Law/Patents Law: Contract(s) Loan Contract

"Erweist sich eine Bestimmung dieser Vereinbarung als unwirksam, so berührt dies die Wirksamkeit der übrigen Bestimmungen der Vereinbarung nicht. In diesem Fall vereinbaren die beiden Vertragsparteien die unwirksame Bestimmung durch eine Bestimmung zu ersetzen, die der wirtschaflichen Zweckrichtung der unwirksamen Bestimmung nach dem erkennbaren Willen der Vertragsparteien am nächsten kommt."

"Should a provision in this agreement prove inapplicable, this will not affect the validity of the remaining provisions in the agreement. In a case such as this, both contracting parties will [...] agree to replace the inapplicable provision with a provision that comes closest to fulfilling the economic purpose of the inapplicable provision."

The usual Schlussbestimmungen from an Austrian loan contract. But I don't know what to do with "nach dem erkennbaren Willen" and whether the translation of this phrase could not be slipped into the space between the square brackets??
