I wish to respectfully refer to and respond to the request from the Austrian Embassy dated 10/05/2018, and received via email on Friday morning, 11/05/2018.
As a reminder, my application was submitted at the VFS, Lagos on 10th April, 2018, and in it I included all the required documents and had my biometrics collected. Among the documents submitted were:
1. Documentary evidence of my letter of appointment as a Senior lecturer at Yaba College of Technology, Lagos, a Federal Government owned higher educational institution; indeed the first such institution established in Nigeria in 1947. I also submitted evidence of the confirmation of my appointment, as well as months of salary payment slips. In addition, I presented a letter of introduction signed by the Registrar of Yaba College of Technology, to authenticate my career status.
2. I then also submitted my personal First Bank of Nigeria account details which has substantial money, but more importantly which shows that I receive monthly payments of salaries and allowances from the Federal Government employment in Yaba College of Technology.
3. I also provided evidence of flight booking, travel insurance and Four Seasons transportation to and from Vomperberg, Tyrol, which is my destination for the religious festival.
4. I also included documentary evidence of my registration for the Festival, as well as confirmed booked accommodation at Vomperberg.
Let me also state that last year, I also applied to the Austrian Embassy to attend the September Festival 2017, and was denied Visa, for similar reasons as now canvassed. On that occasion Mrs D. Bernhardt, as representative of the Grail Settlement in Vomperberg, Tyrol, personally wrote a letter of introduction and confirmation of my trip; yet the assessor did not accept her explanations.
Let me mention the following:
It seems to me, clearly, that the assessor of my documents merely relies on guess work, and has not done a factual and accurate assessment of my application and my personality. The opinion conveyed in the email letter of 10/05/2018 seems clearly pre-meditated, biased, unfair, inaccurate and done hastily. I say these because:
1. I was never re-invited for questioning on any of the documents I submitted, including even on my finance. In the past the Embassy could even ask an applicant to beef up his or her finances, if it was thought inadequate. I could easily do so from my other bank accounts. I believe the important thing should be the genuineness of the source of income. On this occasion I have enough funds in my account to cater for my trip.
2. My application was submitted on 10/04/2018, and nothing was heard till the end of April, well over 15 working days. Then on 08/05/2018, out of frustration, I did an email to the Embassy. Then following this on 10/05/2018 I received this letter requesting for my response. This is coming well over 25 working days, and only 12 days to my planned trip. Thereby I am put under intense pressure and uncertainties.
3. The findings seem over generalised and are not flowing from any proper assessment of the documents I submitted.
4. It is therefore purely guessed work, and not factual.
5. I have verifiable Federal job, verifiable family ties, and verifiable destination address. I have verifiable travel insurance and local transportation. It does appear that the assessor never bothered to truly verify all of these with good conscience.
Final Appeal:
May I therefore, your Excellency, appeal that this time, these issues be resolved in my favour and I definitely have enough credible evidence in both documentation and personal standing to justify my Visa application. Thank you and best regards. May I expect a quick response to enable me finalise arrangements for the travel next week 22nd May, 2018.

Excellenz!
Mit allem Respekt nehme ich zum Schreiben der Ӧsterreichischen Botschaft vom 10.05.2018, das ich per E-Mail am Freitag Morgen 11.05.2018 erst erhielte, folgendermassen Stellung.
Zur Erinnerung wurde mein Antrag an die VFS-Stelle, Lagos am 10ten April 2018 samt aller benötigten Dokumente eingereicht. Meine biometrischen Daten wurden auch aufgenommen. Unter den eingereichten Dokumenten befanden sich:
1. Mein Anstellungsscheiben als Dozent an der Technischen Universitӓt Yaba, Lagos, einer Hochschule der Bundesrepublik Nigerias; sogar die erste Bildungsstӓtte dieser Art, die 1947 gegründet wurde. Ich habe sowohl ein Bestӓtigungsschreiben,um diese Anstellung nachzuweisen, als auch monatliche Zahlungsbelege eingereicht. Zusӓtzlich habe ich ein Schreiben, unterschrieben vom Registrar der Technischen Universitӓt Yaba, um meinen Berufsstand zu authentizieren, vorgelegt.
2. Meine persönlichen Kontoauszüge von First Bank Nigeria, die eine ansehnliche Summe vorweisen aber wichtiger noch beweisen, dass ich regelmӓβige Monatsgehӓlter und Zuschüβe aufgrund meiner Tӓtigkeit als Dozent der Technischen Universitӓt Yaba erhalte.
3. Reisebuchungen, Reiseversicherungen und Transport durch „Four Seasons“ Reisebusservice hin- und zurück nach Vomperber, Tyrol,das mein Reiseziel ist; der Ort eines religiösen Festes, an dem ich teilnehmen will.
4. Nachweis meiner Anmeldung zur Feier als auch bestӓtigte Unterkunft auf dem Vomperberg.
Erlauben Sie mir auch hinzuweisen, dass ich im letzten Jahr einen Visaantrag an die Ӧsterreichische Botschaft wegen Teilnahme an der Septemberfeier auf dem Vomperberg 2017 einreichte. Der Antrag wurde aus ӓhnlichen Gründen wie diese hier abgelehnt . Im letzteren Fall hatte Frau Diane Bernhardt, eine Vertreterin der Gralssiedlung ,Vomperberg, Tyrol ein persönliches Vorstellungsschreiben aufgefasst und meine Reiseabsicht bestӓtigt;trotzdem hat der Sachbearbeiter ihre Erklӓrungen nicht akzeptiert.
Erlauben Sie mir bitte die folgenden Schluβfolgerungen:
Mir ist es klar, dass der zustӓndige Sachbearbeiter meine Dokumente lediglich auf Basis von Mutmaβungen bearbeitete und eine sachliche und genaue Prüfung meines Antrags und meiner Person nicht unternommen hatte. Die Bedenken vermittelt im Schreiben per E-mail vom 10.05.2018 scheinen mir persönlich als eindeutig vorgedacht,voreingenommen, unfair,ungenau und voreilig.Dies behaupte ich aus folgenden Gründen:
1. Ich wurde nicht zu einer Vorsprache über die Dokumente, die ich einreichte, einschlieβlich Dokumente über meine finanzielle Lage nochmal eingeladen. Ich erinnere mich, dass in der Vergangenheit die Botschaft Visaantragsteller gebeten hatte Ihre Finanzen aufzustocken, falls sie nicht ausreichend waren. Ich hӓtte das ohne weiteres von meinen anderen Konten vornehmen können. Ich glaube aber, dass die Echtheit der Einkommensquelle massgebend ist. In diesem Fall habe ich ausreichende Mitteln um die Reise anzutreten.
2. Mein Visaantrag wurde am 10.04.2018 eingereicht und bis zum Ende April, nach 15 Arbeitstagen also, hatte ich keine Antwort bekommen. Aus der Frustration heraaus habe ich dann am 08.05.2018 eine Mail an die Botschaft gerichtet. Am 10.05.2018 habe ich dann das Schreiben mit Bitte um Stellungnahme bekommen . Dieses Schreiben kommt 25 Arbeitstage nach Einreichung meines Visaantrags und 12 Tage vor der geplanten Reise. Dadurch bin ich nun unter extrem Druck gesetzt und groβen Unsicherheiten ausgeliefert worden.
3. Die im Schreiben aufgeführten Bedenken sind Verallgemeinerungen und lassen sich von einer sachlichen und rechtsmӓβigen Prüfung der Dokumente, die ich eingereicht hatte,nicht herleiten.
4. Sie sind reine Mutmaβungen und entsprechen nicht der Realitӓt
5. Ich habe eine verifizierbare Arbeitsstelle bei der Bundesregierung, verifizierbare Familienverbindungen und eine verifizierbare Zieladresse.. Ich habe eine verifizierbare Reiseversicherung und einen verifizierbaren Transport vor Ort. Mir scheint es, dass der Sachbearbeiter sich nach bestem Wissen und Gewissen um eine Verifizierung dieser Dokumente nicht bemühte hatte.
Dringender Appell:
Darf ich deshalb Ihre Excellenz bitten, dass diesmal die oben aufgeführten Kernpunkte berücksichtigt und mein Antrag positiv zu meinen Günsten entschieden werden kann? Ich habe meines Erachtens ohne Zweifel genügend echte und glaubhafte Nachweise meine Dokumenten und meine Person betreffend eingereicht, um eine Visaerteilung zu rechtfertigen. Ich bedanke mich bei ihnen, dass Sie die Zeit genommen haben, dieses Schreiben durchzulesen.
Darf ich mit einer zeitnahen Antwort rechnen, um meine Reisevorbereitungen für die Abreise am 22ten Mai 2018 abzuschieβen?

OVERVIEW
The construction sector in Nigeria is estimated at US$12.5billion per annum. Major projects are executed by foreign companies. Germany’s Julius Berger with annual revenues in Nigeria of around US$1billion remains the company to beat.
In recent years, Chinese firms have continued to increase their market share with aggressive pricing strategies along with good quality and timely project deliveries.
Indigenous companies play in the small and medium scale segment with individual firms earning less than US$10million per annum.
PROCUREMENT PROCESS
The contract bidding and contractor selection process in both the public and private sector has become increasingly rigorous and transparent. There is usually a pre-qualification process whereby interested construction firms are assessed based on such criteria as:
• Experience and track record in the execution of similar projects;
• Technical and managerial personnel;
• Construction equipment;
• Financial strength; etc.
START-UPS
While the increased rigor in the contractor selection process has greatly improved competitiveness and quality of project deliveries, it has, however, had the undesirable effect that new companies/start-ups are practically shut out of the process because of their inability to meet clients’ pre-qualification criteria.
PARTNERSHIPS
Collaborations with existing companies have provided a viable option for new companies to enter into the market. Joint Ventures, Consortia and Limited Partnerships are formed with established companies to bid for contracts.
The collaborations can be equity-sharing or non-equity based. In the latter case, the established company provides technical support and undertakes with the start-up to guarantee project performance in return for a share of profits or a negotiated fixed fee.
AMAZON INFRASTRUCTURE LTD
This is a start-up formed by three experienced professionals in the construction sector in Nigeria. Between them, they have over 100 years experience in construction management, civil engineering consulting, public administration and business management.
• Mr Akugbe Michael Ozigbo is currently the Vice President and Chief Operating Officer of CAT Construction Group Ltd with annual revenues in excess of US$5million. He is a Project Management Professional with an undergraduate degree in Physics from the University of Lagos, Nigeria and a post-graduate Certificate in Project Management from the University of Liverpool, England. He has over 40years post qualification experience, starting out his career as a quality control officer in Aufbau Construction in 1976.
• Engineer Anthony Taiwo Oyekan is the Chief Executive Officer/Technical Director of TOG Environment & Infrastructure Ltd, a leading civil engineering consulting firm in Nigeria. He is a Fellow of the Nigerian Society of Engineers and a Registered Engineer in the State of Texas, USA. He obtained his first and second degrees in civil engineering from the University of Houston, Texas, USA and was at a time a member of the Greater Dallas Planning Council. He has over 39 years professional engineering consulting experience in the USA and Nigeria.
• Mr Adejoju Joy Oni is currently the Head of Administration & Human Resources at CAT Construction Group Ltd. He is a Fellow of the Chartered Institute of Administration. His obtained his first degree in Government & Public Administration and a Masters in Business Administration. After a distinguished career in the public sector where he headed a strategic department in the Administration of a major Federal Government Institution, Mr Oni moved over to his present position in CAT Construction. He has over 35years administrative and management experience under his belt.

THE PARTNER WE SEEK
An innovative construction company with impressive track record in the delivery of diversified civil engineering and infrastructure projects to partner with Amazon Infrastructure to exploit the Nigerian market. We offer the option of an initial engagement that starts out with near zero financial risk on the part of the Technical Partner (TP) through a non-equity based technical collaboration that, subject to the achievement of set targets can then gradually metamorphose into a full-fledged equity-sharing Joint Venture.
What is needed at the beginning is the signing of a Memorandum of Understanding or Consortium Agreement wherein the parties agree to submit joint bids for infrastructure projects in Nigeria with Amazon Infrastructure (Amazon) being the operating Partner while the Technical Partner (TP) supports with engineering and construction quality management know-how. Whenever the TP needs to send down resources - personnel or equipment – to facilitate the timely and qualitative delivery of a project, the expats’ remunerations as well as plant hire/lease costs will be borne by Amazon.
The fees payable to the TP for their services will be negotiated as either a percentage of profit or as a fixed percentage of the total value of contracts won and executed. Meanwhile, Amazon will bear the full costs of procuring the contracts.
PROJECTIONS
With the right partner, we would be able to bid for and win large projects along with foreign companies that have, up till now, dominated the construction industry in the country. Our starting point, however, will be the Federal Capital Territory Administration, Abuja where we have excellent relationships at the highest levels in addition to possessing excellent knowledge of the Contract Procurement Process. Accordingly, we project total revenues over the next five years: 2019 – 2024, in excess of US$100m, with net profits averaging 15%.
CONCLUSION
We know of specific projects already earmarked for procurement in 2018 which we definitely want to bid for. Our search for a suitable Partner is now for us, a top priority. We therefore warmly welcome contacts with interested and qualified companies whose business aspirations align with our own plans.

Sie haben am 02.05.2018 bei der Osterreichischen Botschaft Abuja einen Antrag auf Erteilung eines Visums der Kategorie C eingebracht.
Eine Prufung hat ergeben, dass im Grunde der Verordnung (EG) Nr. 810/2009 des Europaischen Parlaments und des Rates vom 13. Juli 2009 uber einen Visakodex der Gemeinschaft (EU Visakodex) folgende Bedenken gegen die Erteilung eines Visums, wie dies von Ihnen beantragt wurde, bestehen:
