Кстати, хотелось бы узнать у кого-то, кто думает по-английски, что для них означает «judicial act» (сам я так не перевожу, но только что из любопытства посмотрел на британских сайтах: там везде «act» – это либо закон, либо действие (в т. ч. судебных органов). Но почему приказное производство превратилось в производство о пересмотре судебных актов в порядке надзора (из другого раздела АПК) – загадка; видимо, старую версию переводили

А все-таки в переводах там столько ляпов, что можно разбор делать со студентами-переводчиками, хотя бы даже в том, как он оперирует словом «case» (в первый перевод хоть «instances» ввели). «Направление» нельзя переводить ни глаголом «direct» (хотя «this letter is directed to» – корректная формулировка, но в смысле указания адресата), ни глаголом «forward» (он только в случае перенаправления полученного кому-то работает)

Согласен с тем, что "application for proceedings – это все равно не то".

Поэтому, на мой взгляд, следует использовать вариант перевода, выполненного в Высшем арбитражном суде РФ, где "о принятии искового заявления или заявления к производству" переводится как "of the acceptance of the statement of claim or of the application":

лица, участвующие в деле, и иные участники арбитражного процесса извещаются арбитражным судом о принятии искового заявления или заявления к производству и возбуждении производства по делу, о времени и месте судебного заседания или совершения отдельного процессуального действия путем направления копии судебного акта в порядке, установленном настоящим Кодексом <-> The commercial court notifies the persons participating in the case and other participants of the commercial proceedings of the acceptance of the statement of claim or of the application and of the institution of proceedings in the case, of the time and place of a court session or of the performance of an individual procedural action, by forwarding a copy of the court act in the manner, established by this Code

Но application for proceedings – это все равно не то. И исковое заявление и просто заявление в данном случае оба принимаются к производству, т. е. accepted for hearing, а дальше уже отдельно про возбуждение proceedings

Таким образом становится очевидным, что АПК РФ четко разграничивает понятия "исковое заявление" <-> "statement of claim" и "заявление" <-> "application" как допустимые формы обращения в арбитражный суд. А при переводе п. 1 ст. 121 я бы использовал английский текст, приведенный на сайте И.Н. Упорова, поскольку данный перевод был выполнен консультантом Управления международного права и сотрудничества Высшего Арбитражного Суда РФ и, наверняка, прошел уйму согласований:

"о принятии искового заявления или заявления к производству и возбуждении производства по делу" <-> "of the acceptance of the statement of claim or of the application and of the institution of proceedings in the case".

Не скажу, что мне понятна здесь суть (поиск подобных выражений не выводит ни на что интересное), но кажется, что суд может либо принять заявление в свое производство или направить куда-то еще. Оба заявления в этой парадигме будут иметь вид statement of claim, а разграничить можно, например, так: "Once the commercial court has accepted a statement of claim (whether or not to be heard directly before it), it shall notify the persons..." и т. д. Не исключено, что я угадал неправильно, а вот приведенные ниже тексты лишний раз убеждают меня, что годных переводов наших юридических документов в открытом доступе не существует, разве что немногие, которые можно найти в исполнении компаний типа Big Four, но и к ним есть вопросы
